1. Who we are and what this policy covers
Migration Prospects ("Migration Prospects", "we", "us" or "our") is the business name of Migration Prospects Pty Ltd as trustee for the SAFI Trust (ABN 56 382 901 220), and provides Australian migration guidance, planning tools and professional migration services. 2. Personal information we may collect
Depending on how you interact with us, we may collect:
- Contact and enquiry information — name, email, phone number, and the content of your enquiry.
- Booking information — consultation type, preferred times, and payment details processed through our booking and payment provider (we do not store full card numbers ourselves).
- Client and matter information, where you engage us for professional services — this can include identity and travel documents, citizenship and immigration history, relationship and family information, employment, education and qualification history, sponsorship and financial information relevant to your matter, government correspondence, and — where relevant to your specific application — sensitive information such as health, disability, racial or ethnic origin, and criminal history information.
- Information about another person connected with your matter — such as a sponsor, employer, family member or referrer — where you provide it. Please only provide another person's information if you are authorised to do so and it is relevant to the matter.
- Free tool responses — the Pathway Finder and Document Checklist store your answers only in your own browser's local storage. This information is not transmitted to us and is not personal information we hold, unless you separately choose to share it with us (for example, by quoting your results in an enquiry).
- Website and device information, such as IP address, browser type, referring page and basic activity logs, where analytics or similar technologies are in use (see section 12).
3. Sensitive information and consent
Migration matters can unavoidably involve sensitive information as defined by the Privacy Act — for example, health information relevant to a visa's health requirement, or character and criminal history information relevant to the character requirement. We only collect sensitive information:
- with your consent (which you give by providing it to us in the course of a migration matter you have asked us to assist with); or
- where collection is required or authorised by law, including under the Migration Act 1958 and its Regulations.
You may withdraw consent for an optional use of sensitive information, but this may affect our ability to provide a requested service. Withdrawal does not affect anything already lawfully done with the information, or information we are required to retain. We do not use sensitive information for any purpose beyond the matter for which it was provided, except with your consent or as required by law.
4. How we collect personal information
We collect personal information directly from you — through enquiry forms, consultation bookings, email, phone, secure document upload, or other communications. With your authority or where permitted by law, we may also receive information from a family member, sponsor, employer, representative, referrer, government body, reviewing authority, skills assessor or education provider involved in your matter. We do not collect personal information about you from publicly available sources except where relevant and necessary to a matter (for example, verifying a stated migration decision through official channels).
5. Why we collect, hold, use and disclose personal information
We use and disclose personal information, where reasonably necessary, to:
- respond to enquiries, assess whether we can act, and schedule consultations;
- provide immigration assistance and related professional services within an agreed scope, including preparing, lodging and managing applications, submissions and reviews, and communicating with the Department of Home Affairs, the Administrative Review Tribunal and other relevant bodies on your behalf, with your instructions;
- meet our professional, legal, insurance, taxation and accounting obligations, including record-keeping obligations under the Migration Agents Code of Conduct;
- issue invoices and receipts, process payments, and manage complaints;
- secure, administer and improve our website and services; and
- send you information you have specifically opted in to receive (see section 11).
We do not sell personal information, and we will not use it for a purpose unrelated to your matter or enquiry without your consent, unless otherwise required or permitted by law.
6. Website forms, tools and automated features
The Pathway Finder, Readiness Score, Document Checklist and Consultation Selector provide general information only. They do not provide immigration assistance, determine eligibility, rank or recommend a pathway, predict an outcome, or replace advice from a registered migration agent. Where a tool submits your answers to us or uses an external provider to do so, this will be stated at the point of collection. We do not permit artificial intelligence or automated systems to independently give migration advice or make a final professional decision about a client matter — every substantive decision is made by a registered migration agent.
Please do not enter passport numbers, health or character information, or other confidential documents into a general website form or tool. Once you are a client, we will provide a secure, authenticated channel for this material.
7. Who we may disclose information to
Where necessary, authorised or permitted by law, we may disclose personal information to:
- our registered migration agents, authorised staff and contractors, who are subject to confidentiality and access controls;
- the Department of Home Affairs, the Administrative Review Tribunal, courts, and other Australian or, where relevant, overseas government authorities connected with your matter;
- skills assessing authorities, education providers, employers, sponsors, professional bodies, and interpreters or translators, where relevant to your matter;
- service providers who support our practice — for example, our website hosting, email, booking and payment platforms, and accounting software — solely to enable them to provide those services to us;
- our insurers, auditors, accountants, legal advisers and regulators; and
- another registered migration agent, or another professional or service provider, where you ask or authorise us to make a referral or transfer your file.
We limit disclosures to what is reasonably necessary for the relevant purpose. We do not disclose personal information to any third party for their own marketing purposes, and we do not sell personal information.
Overseas disclosure
We primarily provide services to clients located in Australia. Migration work can, however, involve disclosure to people, organisations or authorities outside Australia connected with an applicant, sponsor, employer or qualification, and some of the service providers we use to run this website and deliver our services — for example, our cloud hosting, email, and appointment-booking and payment platforms — may store or process personal information on servers located outside Australia. Where Australian Privacy Principle 8 applies, we take reasonable steps in the circumstances to ensure overseas recipients handle personal information consistently with the Australian Privacy Principles. If you would like more information about the specific overseas locations involved in a particular service, contact us using the details in section 1.
8. Storage and security
We use administrative, technical and physical safeguards appropriate to the nature of the information we hold, including access controls, multi-factor authentication where available, staff confidentiality obligations, vendor assessment, backups and secure disposal. Client files are kept securely and confidentially, consistent with our professional duty of confidentiality under the Migration Agents Code of Conduct. No method of transmission over the internet is completely secure — please use the secure upload or portal method we nominate for confidential documents, rather than general website forms or unencrypted messaging.
Migration Prospects will never ask you for your password, a one-time verification code, a full payment card number, or to pay fees into a personal or unfamiliar account. If you receive a message like this claiming to be from us, please do not respond, and contact us directly using the details on this page.
9. Retention and disposal
In line with our obligations as registered migration agents, we retain client file records for 7 years after the last action on the file, consistent with the Migration Agents Code of Conduct. Enquiry and marketing records that never become a client matter are kept only as long as reasonably needed. When information is no longer required, we take reasonable steps to securely destroy or de-identify it, subject to backups and any longer retention required by law, insurance or an active dispute.
10. Data breaches
We maintain a data-breach response process. Where the Notifiable Data Breaches scheme applies, we will assess a suspected eligible data breach and, where required, notify affected individuals and the Office of the Australian Information Commissioner.
11. Marketing communications
We only send marketing or newsletter-style updates if you have separately opted in to receive them — marketing consent is optional, is never a condition of making an enquiry or receiving a service, and is recorded separately from your service communications. Every marketing message identifies us and provides a working unsubscribe method, and we action unsubscribe requests within the timeframe required by the Spam Act 2003 (Cth). Service, appointment, invoice and matter-related communications are not marketing messages and are not affected by an unsubscribe request.
13. Children and third-party links
Where a matter concerns a child, we collect information from or with the involvement of a parent, guardian or other authorised person, as appropriate. Our website may link to third-party websites; their privacy practices are governed by their own policies, not this one.
14. Access, correction, and complaints
You may ask us what personal information we hold about you, request correction of it, or request its deletion, by contacting us using the details in section 1. We may need to verify your identity before responding, and we will respond within a reasonable time and, in most cases, without charge.
If you believe we have breached the Australian Privacy Principles or this policy, contact us with enough detail for us to investigate. We will acknowledge your complaint and aim to provide a substantive response within 30 days. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
Complaints about the professional conduct of a registered migration agent (as distinct from a privacy complaint) may also be made to the Office of the Migration Agents Registration Authority (OMARA) at mara.gov.au. We encourage you to raise any concern with us directly in the first instance so we have the opportunity to resolve it.
15. Changes to this policy
We may update this policy when our practices or legal obligations change. The current version and its last-updated date will always appear on this page. We will give additional notice if a material change requires it.
