Decision and review support

Received a visa refusal or migration decision?

Some decisions may carry strict review or response time limits. Keep the complete decision documents, note how and when they were received, and obtain prompt professional review if you are unsure what options may be available.

Migration Prospects is an independent migration-services provider and is not affiliated with the Australian Government, the Department of Home Affairs, the Administrative Review Tribunal, or any state or territory government.

A strict time limit may apply

Review or response periods can depend on the decision type, how and when the notice was given, your location, and other legal factors. Do not rely on a general webpage to calculate the deadline. Keep the complete decision documents and obtain prompt professional review.

Receiving a refusal or cancellation can be difficult and confusing. The immediate priority is to preserve the complete documents and understand whether a time limit or status issue requires attention.

What to do now

  1. Keep every page of the decision letter and attachments.

  2. Record when and how the decision was received.

  3. Do not alter or annotate the original files.

  4. Check whether the documents mention review rights or a time limit.

  5. Note your current visa and location.

  6. Avoid making assumptions from online examples.

  7. Obtain prompt professional advice if a deadline may apply.

  8. Keep evidence of any submission or communication already made.

What type of decision are you dealing with?

Each situation has different priorities. These summaries are orientation only — not a legal classification of your matter.

Visa application refused

Some refusals can be reviewed by the Administrative Review Tribunal. Whether review is available depends on the decision documents, your location and timing.

Visa cancelled

Cancellations raise both review and visa-status questions. Both may need attention promptly, and travel decisions need individual advice first.

Notice about possible cancellation

A notice inviting comment usually has a response window. The response should address the actual concerns raised, which takes careful reading.

Employer sponsorship or nomination refused

Business-side refusals have their own review considerations, and the worker's position may need separate attention.

ART decision received

Options after a Tribunal decision depend on the outcome and are jurisdictionally complex. Prompt specialist advice matters here.

Request for further information or comment

Requests have response windows and address specific concerns. Responding well matters more than responding fast — but do not miss the window.

Court or judicial review question

Judicial review examines legal or procedural error and differs from merits review. Court deadlines and jurisdictional questions require urgent specialist legal advice.

I'm not sure what I have received

That is common — decision documents can be confusing. Keep everything and have the complete documents reviewed promptly.

Can the decision be reviewed?

Some migration decisions can be reviewed by the Administrative Review Tribunal, while others may have different review options or no merits-review pathway. Review rights depend on the legal basis of the decision, the applicant or sponsor, location, timing, and the terms of the notice.

The decision documents must be reviewed before Migration Prospects can confirm whether a particular review pathway may be available.

What the Administrative Review Tribunal does

Merits review generally involves reconsidering the decision under the applicable law and information. Depending on the matter, the Tribunal may consider documents, submissions, testimony, and other relevant material.

Judicial review generally examines whether a legal or procedural error affected the decision-making process. It is different from merits review, and court deadlines and jurisdictional questions require urgent specialist legal advice.

The Tribunal is an independent government body. Migration Prospects has no special access to or influence over it, and engaging any professional service does not affect how the Tribunal treats a matter.

Your current visa status may need separate attention

A review application does not automatically resolve every visa-status issue. Status, work rights and travel each need separate attention while a matter is active.

Travel can affect visa status, bridging visas, review processes, or the ability to return to Australia. Obtain individual advice before travelling if a decision or review matter is active. Work or study rights depend on the current visa and any conditions in effect — a refusal or review process does not create a universal entitlement to work or study.

Evidence and information for review

Evidence should be considered in relation to the actual reasons for the decision. Submitting more documents without understanding the issues may not address the problem.

New evidence may be relevant in some review matters, but whether and how it can be considered depends on the review jurisdiction, the issues, and applicable rules. Professional review is needed before relying on a new-evidence strategy.

Information provided to Migration Prospects, the Department, the Tribunal, or a court must be truthful and accurate. Do not create, alter, or obtain false documents or ask another person to provide information they do not believe is true.

How an ART review may progress

  1. Government decision received

  2. Review rights and deadline assessed from the documents

  3. ART application, where available and chosen

  4. Preparation around the actual issues

  5. Tribunal process — documents, hearings or both

  6. Tribunal decision

  7. Further steps depend on the outcome

Not every decision has ART review rights, and the exact process varies. Depending on the Tribunal’s powers and the matter, it may affirm the original decision, set it aside, vary it, remit it for reconsideration, or take another action permitted by law. Tribunal application fees and fee-reduction arrangements can change — confirm current official amounts before lodging.
